1. Order placement
By placing an order, the customer accepts the terms of delivery and payment of DI Maximilian Fiskas. The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation for the customer to place an order. The purchase contract is concluded as soon as the order is accepted through an order confirmation or by the dispatch of the goods.
2. Availability
We strive to ship all ordered items in full and within the stated delivery times. Should an ordered item exceptionally not be available, the customer will be informed immediately. Payments already made for items that cannot be delivered will be refunded. There will be no automatic back-delivery of unavailable items unless otherwise agreed with the customer. After the goods have been handed over to the shipping service provider, we have no influence on the further delivery process. We accept no liability for delays caused by parcel services, transport companies, or other third parties for which we are not responsible. Should delivery delays occur that are beyond our control, we will inform the customer if possible and assist in clarifying the matter with the shipping service provider. The statutory rights of the customer remain unaffected.
3. Retention of title
The delivered goods shall remain the property of DI Maximilian Fiskas until full payment has been received.
4. Delivery
Delivery is made to the delivery address provided by the customer. The customer is responsible for providing a correct and complete delivery address. Changes to the delivery address after the contract has been concluded can only be taken into account if the order has not yet been dispatched.
5. Cost allocation agreement
If the customer exercises their statutory right of withdrawal, they shall bear the direct costs of returning the goods.
6. Return
6.1 Return costs
The purchase price will be refunded using the same method as your original payment. The costs for returning orders are to be borne by the buyer.
6.2 Condition of the returned goods
The customer must handle the goods in such a way that it is possible to inspect their nature, properties, and functionality. The customer is only liable for any loss in value of the goods if this loss in value is due to handling the goods in a manner that exceeds what is necessary for the inspection. In the case of model vehicles, a damaged or missing original packaging, missing accessories, or damage to the model can lead to a reduction in value. This reduction in value can be significant if you open the packaging as well as the plastic bags inside the packaging and/or return only individual parts rather than the entire product, and you may receive a lower refund in the event of a cancellation.
6.3 Exclusion of the right of withdrawal
The statutory right of withdrawal does not apply to goods that have been manufactured according to customer specifications or are clearly tailored to the customer's personal needs. For questions regarding returns, the customer can contact us at any time.
7. Warranty
The statutory warranty provisions apply. In the event of defects in the delivered goods, consumers are entitled to their statutory rights. For complaints, please contact us using the contact details provided in our legal notice.
8. Data Protection
The processing of the customer's personal data is carried out in compliance with applicable data protection regulations, in particular the General Data Protection Regulation (GDPR). You can find more information here.
9. Battery Ordinance
Insofar as batteries or rechargeable batteries are included in the scope of delivery or are sold by us, we are obliged as a retailer to inform customers of the statutory return options. Batteries and rechargeable batteries must not be disposed of with household waste. Consumers are legally obliged to return used batteries and rechargeable batteries to a suitable collection point, a municipal return facility, or a retailer. Batteries containing harmful substances are marked with the symbol of a crossed-out wheeled bin and chemical symbols (Cd for cadmium, Hg for mercury, or Pb for lead).
